FORMER FIREMAN GUILTY OF ASSAULT ON CYCLIST

WLOS news in Asheville, NC is reporting that former Asheville Fireman Charles Diaz has plead guilty to assaulting a cyclist in the summer of 2009. The assault occurred when Diaz pulled over an Asheville cyclist and his family “out of concern” for the safety of the couple’s child, whom they were carrying in an approved seat on their bike.  The confrontation escalated to the point where Diaz fired his gun at the cyclist. The bullet pierced the helmet of the victim.

He was sentenced to 4 months active sentence followed by 30 months of probation and a requirement that he attend anger management classes. The prosecution used one of his supervisory evaluations within the Fire Department as evidence of a an ongoing inability to control his anger. As I recall, the evaluation indicated that he had a tendency to get involved in matters and then "blow them up".

Thanks for the note on the broken link. I think the original story link had expired so I found an AP report and replaced it so the second link should be live again.

I too hope that something positive can result from this. Unfortunately, there is probably an equal chance that the two communities will only become more polarized over it.
